High Court Judge declines to stop Sonko’s planned impeachment and Voi assault case

High Court judge Weldon Korir has declined to stop the planned impeachment of embattled Nairobi Governor Mike Sonko who is facing a Ksh.357 million graft case.

The judge instead directed the parties; George Bush and Lawrence Oyugi of Concerned Citizens Alliance, to file a formal application in regard to the intended impeachment.

The two through an oral application told the court that there is a plan by some Nairobi Members of County Assembly to impeach the governor who was barred from accessing office after he was charged with several corruption related charges.

At the same time, the court declined to stop the criminal proceedings launched against Sonko for allegedly assaulting police officers during his arrest on December 6, 2019 in Voi.

The parties have been directed to serve the Director of Public Prosecution (DPP) with an application they have filed seeking to stop Sonko’s prosecution.

“…the status of Sonko is an unconvicted man with equal rights especially that of presumption of innocence until proven guilty was not recognised,” reads the petition.

They further argue that Sonko’s rights as an accused person have been infringed therefore he is not properly before the court as an accused person but a victim.

Sonko is expected to appear before a Voi court on Wednesday to answer to assault charges.
